HYAPPI, LDA, the company that owns the HYAPPI, LDA® brand and the website www.hyappi.pt, respects the privacy of those who use our products and services, including the websites and applications we provide. In this document we refer to HYAPPI, LDA as “HYAPPI, LDA®”, “we” and “our”; and to you as “customer”, “user”.

This “Privacy Policy” document explains how we process and store any personal data belonging to the customer/user, that is, information that allows us to identify you, such as your name, address, telephone number, email, among others. This information is referred to in this document as personal information or personal data.

HYAPPI, LDA® may subcontract third parties to process personal data collected. The companies we hire are carefully chosen to ensure that they have implemented the necessary procedures to comply with legislation on the protection of personal data. HYAPPI, LDA® maintains the hyappi.pt platform where we record the data that supports our sales and marketing and advertising campaigns. Access to and processing of your data is safeguarded by the contract entered into with this company, as well as by procedures and good practices that aim to minimize the risk of improper access to data, as well as information leaks.

Hyappi.pt provides a platform used to create, manage and send newsletters/information from HyAPPI, LDA®.

(Social Networks) – These are companies that own social networks used by HYAPPI, LDA® to promote and advertise products and services. Their relationship with Facebook and Instagram is regulated by the privacy policy of the platforms themselves.

Google -– Is a company that owns several products and a vast online advertising network, used by HYAPPI, LDA® to promote and advertise its products, services and promotions. Your relationship with Google is regulated by its Privacy Policy.

HYAPPI, LDA® may change the list of subcontracted entities at any time.

We do not share your data with other companies for the purposes mentioned above or for any other purposes.

PROTECTION OF YOUR PERSONAL INFORMATION

We implement the necessary security measures to ensure the confidentiality of the personal data we collect and process, as well as to prevent its unauthorized dissemination, unauthorized access, loss or destruction of personal data. It is important to note, however, that no security or encryption method can guarantee complete protection of information against hackers or human error.

HYAPPI, LDA®, as the data controller, is obliged to permanently apply appropriate and permanent technical, organizational and control measures to ensure the necessary level of security for the risk, in order to maintain the integrity and confidentiality of the personal data stored and/or transmitted, ensuring that the persons authorized to process the data have assumed a contractual obligation of confidentiality or are legally subject to it.

STORAGE OF YOUR PERSONAL DATA

Your personal data will be kept for the time necessary to guarantee the purpose for which it is intended, and will then be blocked; it is possible that this storage will continue beyond the term of the Contract, in particular for the purposes of legal and/or judicial obligations.

YOUR RIGHTS REGARDING YOUR PERSONAL INFORMATION

You may exercise your rights of access, rectification, deletion, limitation and/or portability by means of written communication, accompanied by a document proving your identity and/or the data to be rectified, if applicable, which must be sent to the email: suporte@hyappi.pt. Any objection to the data processing referred to herein, which is communicated to HYAPPI, LDA® after the start of the same, will only take effect from the date of receipt of such communication, without affecting the legitimacy of any processing carried out up to that point. With regard to the exercise of the right to data portability, please note that, under the applicable legislation, this is only applicable in relation to data collected based on your consent.

The Customer/User, as the data subject, has the right to lodge a complaint with a European Union Supervisory Authority regarding the violation or omission of protection of their personal data, to whom HYAPPI, LDA® will provide full collaboration, providing all information requested by the latter in the exercise of its powers.

Personal data will be kept for the time necessary to guarantee the purpose for which they are intended, and will subsequently be blocked; it is possible that this storage will continue beyond the term of the Contract, in particular for the purposes of legal and/or judicial obligations.

COMPLAINTS

We hope that you will not have any complaints about us or our services. However, if for any reason you are dissatisfied with our use of your personal information, please contact us at suporte@hyappi.pt. You may also file a complaint with the National Data Protection Commission (CNPD) if you believe that the data processing we carry out is not in accordance with applicable legislation.

The Customer/User, as the data subject, has the right to lodge a complaint with a European Union Supervisory Authority regarding the violation or omission of protection of their personal data, to whom HYAPPI, LDA® will provide full collaboration, providing all information requested by the latter in the exercise of its powers.

SPECIAL SITUATIONS

In order to provide services we may need to make personal and anonymous information available to third parties. This will only happen, however, in these specific circumstances:

a) with your express consent;

b) when, in good faith, we believe it is required by law;

c) when we, in good faith, believe it is necessary to protect our rights or property.

Your consent will not be required for disclosure in the situations referred to in paragraph b) and in any case, we will always seek to notify you to the extent possible by law.

If the Privacy Policy changes, we will post a notice on our website. If the change affects registered users, we will notify you via email, push notification or text message.
